Organization: Opera Saratoga (The Lake George Opera Festival Association, Inc. d/b/a Opera Saratoga) (“Opera Saratoga,” “we,” “us,” “our”).

1) Acceptance of these Terms

By accessing or using the Site, you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Site.

2) Changes to the Site or Terms

We may update the Site and/or these Terms from time to time. The “Effective date” above indicates when these Terms were last updated. Continued use of the Site after changes means you accept the updated Terms.

3) Privacy

Your use of the Site is also subject to our Privacy Policy (below), which explains how we collect, use, and share information.

4) Intellectual Property

Unless otherwise noted, the Site content—including text, photographs, graphics, logos, videos, audio, and design—is owned by or licensed to Opera Saratoga and is protected by intellectual property laws. You may view and print pages for personal, noncommercial use only. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

5) Acceptable Use

You agree not to:

  • Use the Site for unlawful purposes or in violation of applicable laws;

  • Attempt to gain unauthorized access to the Site or related systems;

  • Interfere with security features or the operation of the Site;

  • Upload or transmit malicious code, spam, or harmful content;

  • Use the Site in a way that could damage our reputation or services.

6) Donations, Purchases, and Payments

The Site may allow you to make donations or purchases (including memberships or other items) using third-party platforms and processors (for example, Squarespace Commerce and its payment partners).

Ticketing for some events may be handled through third-party sites (for example, a linked ticketing site).

No refunds (general policy): Donations are typically non-refundable except where required by law or where we determine, in our discretion, that a refund is appropriate (for example, duplicate charges or processing errors). If you believe a charge was made in error, contact us promptly (see “Contact” below).

7) Third-Party Links and Services

The Site may link to third-party websites and services (for example, newsletter signup, ticketing, social media, and alternative giving tools). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and privacy policies.

8) Disclaimers

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

9) Limitation of Liability

To the fullest extent permitted by law, Opera Saratoga will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim will not exceed $100 or the amount you paid to us through the Site in the twelve (12) months before the event giving rise to the claim, whichever is greater.

10) Indemnification

You agree to defend, indemnify, and hold harmless Opera Saratoga and its officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Site.

11) Governing Law and Venue (New York)

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be brought in the state or federal courts located in New York, and you consent to their jurisdiction.
